In para 12 " We have already found this the idol is a Shwetambari one. These two facts strongly support the plaintiff's allegations that the temple itself belonged to the Shwetambari Sect We now turn to the evidence oral and documentary which tends to show that this was a fact."
In Para 14, " We are not inclined to belive the defence (Digambars) witnesses on the point of ownership of the temple and its management."
That the Shwetambaris are entitled to the exclusive management of the temple and image of Shri Antriksha Parasnathji Maharaj and they have the rights to worship the image in accordance with their custom. That the Digambaris have a right of worship the image in accordance with an agreement of 1905, that the Digambari sect is permanently restrained from obstructing the Shwetambari sect in getting the image restored to its original form and plastering the same now and hereafter."
But it is a fact that some of the defendants were responsible for the foul deed which, as against the particular defendant is not proved."
In the appeal to the Privy Council ( filed by Digambaris ) Their Lordships observed in Judgement :
Privy Council Judgment :
"The Findings are in favour of Shwetambaris. They had all along been in actual management of the temple and idol. Their title and right of management had been exclusive, and they had been worshipping the image with jewel, ornaments, and painting - the male organ of the deity being covered with the waist-tie and band, for a period which cannot be ascertained but at any rate from 1847-48. That the appellate court has declared and held that the Shwetambaris were on the fact found, entitled to the exclusive management of the temple.
