the matter to the High Court by order dated 30-4-28. The High Court in revision, Cr. R. No. 125-B of 28, rejected the reference by order dated 6-8-28.
7. In 1928, again, the Digambaries raised quarrels over the possession of paoli temple, and its preciants. There was likelihood of breach of peace and the police put up a chalan under Section 145, in Misc. Cr. C. No. 1 of 28. The Magistrate found that the temple was protected Monument, and if, there is liklyhood of breach of peace, action would be taken under section 107 against the Mischief Mongers. Hel therefore, dropped the proceedings by order dated 8-5-28.
8. in 1928, after the order in case No. 15 of 27, was passed, Digambaries went to field S. No. 197, inspite of order under section 145 against them, & obstructed the Shwetambaries, in carrying out the repairs of the Kotha, Ahala, situated in S. No. 197, which was the subject matter of the U/S 447 I. P. C. in cri. c. No. 5 of 28 on the file of Magistrate Second class, Washim, & the Digambaries were found guilty of offence under Section 447, I. P. C. and they were sentenced to pay a fine of Rs. 50/- each, in default to suffer 15 days R. I.
The Digambaries had filed an appeal against that Judgement, the court of Distt. Magistrate, Akola, Cri. A. No. 141 of 28, the appeal was dismissed, by the Dist. Magistrate, by order dated 3-10-28, conviction and sentence were maintained.
9. In 1928 again, inspite of order dated 15-12-27, passed in Misc. Cri. C. No. 15 of 27, the Digambaries went to field S. No. 197, & put up wire fencing to a considerable portion of the field. When the Shwetambaries went to the spot for taking possession of that portion the Digambaries offered physical obstruction. The Digambaries has also forcibly locked up the Kotha in S. No. 197, in possession of Shwetambaries. Thereupon the Shwetambaries complained to that S. D. M. for the alleged breach of his order. The Digambaries were prosecuted and the were sentenced to undergo S. I. for 15 days, & also a fine of Rs. 100/-, in default of payment of fine, to undergo S. I. 15 days more,
