આથી મધ્યપ્રાંતના જયુડીશિઅલ કમીશ્નરની નાગપુરની કેટેમાં સને ૧૯૧૮ ના જુલાઈની ૧૫ મી તારીખે કવેતાંબરએ અપીલ દાખલ કરી. દિગંબરે તરફથી પણ વેતાબરે સામે અપીલ (Cross-appeal) દાખલ કરવામાં આવી. આ અપીલને ચૂકાદ સને ૧લ્ય૩ ના એકબરની ૧ લી તારીખે આવે. ન્યાયાધીશ પી. એસ. કેટવાલ તથા એફ. ડબલ્યુ. એ. પીડ (Prideaux)-બંનેએ મળીને આપેલા ૧૬ પાનાં જેટલા વિસ્તૃત ચુકાદાના અંતમાં બધા પુરાવાની ફેરતપાસ કરીને જણાવ્યું કે-“ આ કેસમાં મુખ્ય પ્રશ્ન સંપૂર્ણ માલિકીને નહીં પણ સંપૂર્ણ વહીવટને છે, તેથી વેતાંબરોને વહીવટને જે સંપૂર્ણ અધિકાર આપવામાં આવે તે તેમને સંતોષ થશેલેપમાં કંદરા અને કોટ વિગેરેને આકાર કેવો કાઢ એની નિશ્ચિત સૂચના આપવાની અમને જરૂર જણાતી નથી.” મંદિર અને મૂર્તિ તે વેતાંબરી જ કબૂલ રાખવામાં આવ્યા.
કેર્ટનું હુકમનામું નીચે પ્રમાણે છે.
() “શ્વેતાંબરોને મંદિર તથા મૂર્તિના વહીવટનો સંપૂર્ણ અધિકાર આપવામાં આવે છે. કટિસૂત્ર-કછટ તથા લેપ કરવાને વેતાંબરેને સંપૂર્ણ અધિકાર છે. તેમની પદ્ધતિ પ્રમાણે ચક્ષુ-ટીકા-મુગટ અને અન્ય આભૂષણે ચડાવવાને પણ તેમને અધિકાર છે.
(આ) સન. ૧૯૦૫ માં થયેલા ટાઈમ-ટેબલની ગોઠવણ પ્રમાણે દિગંબરોને પણ તેમના સમય દરમિયાન ચક્ષુ-ટીકા-મુગટ અથવા આભૂષણથી રહિત મૂર્તિની પૂજા કરવાને અધિકાર છે. માત્ર તેમણે કછોટ, કટિસૂત્ર તથા લેપને ન ખસેડવાં કે તે સંબંધમાં માથું મારવું નહીં.
It is further admitted that the real question in this case is not one of the exclusive ownership but the exclusive management and that the plaintiffs will be satisfied if that is declared. We do not think it is necessary to give any specific directions as to the way in which the restoration of the atti etc., is to be carried out [R. P. P. C., I, 312 ]
The decree of the lower court be set aside and in lieu thereof the following decree is passed declaring
(i) that the Shwetambaris are entitled to the exclusive management of the temple and image of Shri Antariksha Parasnathji Maharaj with Rana, fatti and ear and that they have the right to worship that image with 78, stai, and gns and to put on ornaments over the same ( idol ) in accordance with their custom.
(ii) that the Digambaris have a right of worshipping the image in accordance with the arrangement made in 1905 without aeg, etær and મુટ or ornaments but are not to remove or interfere with #ોટા, જટિસૂત્ર and હે.
