કરવાના ભલે અધિકાર મળ્યા હાય, પણ તેમાં લેપ કયારે કરવા તેમજ લેપમાં કટિસૂત્ર અને કચ્છેાટની પહેાળાઇ તથા જાડાઇનું પ્રમાણ કેટલુ રાખવુ, એની કશી સૂચના ન હાવાથી જ્યાંસુધી કાટ તરફથી એ વિષે નિર્ણય કરવામાં ન આવે ત્યાંસુધી શ્વેતાંબરાને લેપ કરવાની રજા ન મળવી જોઇએ. ' શ્વેતાંબરીએ આ સામે વાંધા ઉઠાવ્યા કે સિવીલ માસીજર કોડની ૪૭ મી કલમ નીચે આ અરજી થઇ શકતી નથી. આકાલાની કોર્ટના ન્યાયાધીશે શ્વેતાંબરાની આ દલીલને મ ંજૂર રાખી. અને ૧૧–૧–૧૯૩૭ ના ઓર્ડરથી દિગંબરાની અરજી કાઢી નાંખી." એટલે દિગંબરાએ તરત નાગપુરની હાઈકામાં અપીલ કરી. હાઇકોર્ટે દિગ ંબરાની અરજી મંજૂર રાખી અને લેપની રીત નક્કી કરવા માટે આ ફેસને આકાલાની કેા ઉપર પાછા મેાકલી આપ્યા. કેસ ચાલ્યા અને તેમાં દિગબરાએ કટિસૂત્ર અને કચ્છેાટના ચિહ્નને બહુ જ આછાપાતળા અને ખારીક અનાવવાની માગણી કરી. શ્વેતાંબરાએ કહ્યું કે ભૂતકાળમાં અંતરિક્ષજીની મૂર્તિના લેપમાં જેવી કિટસૂત્ર અને કચ્છાટની આકૃતિ કાઢવામાં આવતી હતી તેવી કાઢવાનેા અમને અધિકાર મળવે જોઇએ. કોર્ટ અને પક્ષના અનેક સાક્ષીએની જુબાની લીધી અને પુરાવાઓને આધારે ૧૩-૯-૧૯૪૪ તારીખે આવા આશયના નિકાલ ( Order )૨ આપ્યા કે—

૧ મદિરમાં સુધારા-વધારાનું કે પશુ કામ કાઢવામાં આવે તે સામે ગમે તેમ ખાટા વાંધા ઉઠાવવા એ દિગ’ખરાને નિત્યના કાર્યક્રમ થઈ પડ્યો છે. હમેશાં તેમના તરફથી ક્રાઇ ને ક્રાઇ કેસ ક્રમાં ચાલુ ડાય જ છે. જો કે દરેક વખતે તેઓ કાર્ટીમાં હાર્યાં જ કરે છે, અને શ્વેતાંબરા યા જ કરે છે, તા પશુ દિગંબરા નાહક કેસો લખાવીને તેમ જ નવા નવા વાંધા ઊભા કરીને સમાજના પૈસાનુ પાણી કરે છે, અને વૈમનસ્ય ઊભુ` રાખે છે.
૨. 27. Issue No. VI-I-therefore, order that the Shwetambaris ure entitled to restore the image to its original form in the following manner. (i) The Katisutra and the Kachota will be depicted in plaster. (ii) In depicting the two appurtenance on the image, the Shwetambaris shall not exceed their dimensions or form given below. (a) Katisutra:-One inch in breadth (vernical) round the waist from one side to the other, so far as possible. Onethird inch thick, semi-circular in form, i. e. protuberant.
