________________ WHO ARE JAINS ? IN ACCORDANCE WITH BOMBAY HIGH COURT JUDGEMENT A petition filed at the High Court of the then Bombay Province, C.W.J.C 91/1951, by Jain community to the Bench of chief Justice Chagla and Justice Gajendragadkar, the judgement ruled that: "Harijans have no right to entry into Jain temples as these are not Hindu temples. Harijan Temple Entry Act legislation is not the object to do away with the distinction between Hindu and Jain temples. It is well known that Jains are Hindu dissenters and their religious beliefs differ. Jains do not recognise and do not subscribe to Hindu vedas. Jains assign the highest place to their saints known as Tirthankaras, who according to Jaina, have successfully become superior Gods. It is true, according to Judicial decision, in absence of proof or customs and usage to the contrary, the Hindu Law applies to the Jains. Even so, their distinct and seperate entity as a class by themselves, governed by their own religious tenets and beliefs cannot be disputed". Dated 19 August 1949, Bombay State Government in its notification accepted the judgement of the High Court that " Jains cannot be described as Hindus ", thus Hindu Law of 1878 on Jains was squashed. - The Jaina Antiquary, Vol. 40, No. 2 December 1987.
