325 jadicial trial. The greatest merit of British rule is that the subject lives under the reign of law and not under the reign of discretion. The reign of law is the guarantee of the liberty of the subject. The time is gone by when the liberty of the individual could be left at the mercy of executive discretion-or indiscretion. The salutary rule may justifiably be departed from, for reasons of State only in an abnormal time when the safety of the State is in peril. Not the most incurably pessimistic or the most wildly excited man will seriously contend that there is any such exceptional circumstances now in India. We can even understand emergency action taken ander any of the war ordinances, but are wholly unable to make out why a matter that falls within the purview of courts of law and that has no manner of connection with the war should be dealt with in an extraordinary manner with a disregard of the elementary rules of justice. If there is any basis for the numerous questions put by our correspondent, the case of Mr. Arjunlal seems undoubtedly to call for the immediate attention of Lord Hardinge's Government. As we have said at the outset we will not have a particle of syınpathy for Mr. Arjuplal if it should be proved that he has been far froin innocent and unoffending. We will hold that it is in the interest of the State and the country that he should be deprived of his liberty of doing mischief. But it is indispensable that the guilt must first be judicially established. We hope and trust that the Government of India will see their way to publish for general information a full statement of the facts about the case in question. (" Leader,” 22nd December 1914.)
