D. D. M. વાશિમની કેર્ટમાં Cr. c. No. 8/36 ને કેસ દાખલ કરવામાં આપે.
જેના ચુકાદામાં મેજિસ્ટ્રેટ સાહેબે કહ્યું છે કે –
"I hold, therefore, that primafacie the Shwetambaries are entitled to build Dharmshala and Digambaries are not entitled to obstruct the work by any means whether peaceful or ortherwise."
"I also hold that Digambaries have been forcibly obstructing the work,” hence were ordered to execute the bond is this case."
આ ઓર્ડર ઉપર દિગંબરેએ કિ. રિ. નં. ૨૦૬/૩૭ની અરજી દાખલ કરી જે પણ ડીસમીસ કરવામાં આવી હતી.
ત્યાર પછી સન ૧૯૪૦માં વેતાંબરોએ, (૧) મંદિરમાં એક બાકોરું (બારી) ખેલી. (૨) મંદિરના ઘંટની જગ્યા બદલી કે ઘંટ કાઢી નાખે. (૩) ભગવાનની પાછળની ચાંદીની પ્રભાવળ કઢાવી નાખી વિગેરે કારણે માટે ફર્સ્ટ
અસિ. ડિ. જજ અકેલાની કેર્ટમાં દિગંબરોએ ફરીથી, કેસ દાખલ કર્યો. જેનું જજમેન્ટ આપતાં કોર્ટ મહાશયે ચેખ્ખી રીતે કહ્યું છે કે,
“My conclusion then, is that the expression with all its implications, does not mean or include a claim to worship the image with its settings and surroundings.”
“Under these circumstances, I am clearly of the opinion that these acts in Question have not in any way, interfered with the right of worship."
"The matter about the alterations in the temple building is. one, which in my opinion, does not pertain to a right of worship. Therefore I hold that it does not amount to an. interferance in the right of worship.”
- ઉપર પ્રમાણે કહીને કેટે તેમને કેસ ડીસમીસ કર્યો. આ ઓર્ડર ઉપર દિગંબરોએ ફરીથી નાગપુરની હાઈકોર્ટમાં E. A. No. 287 of 44ની અપીલ દાખલ કરી જેને ચુકાદો તા. ૮-૭-૪૭ના રોજ આપતાં નામદાર હાઈકોર્ટે તેમની આ અપીલ પણ રદ કરતાં કહ્યું છે કે,
"The Digambaries' appeared to ine have been generally litiga. ting for the sake of litigation and there is no reason why they should not pay the cost of the other side if the decision goes. against them."
