इतिहासके प्रकाशमें कर दिया है कि जैनधर्म हिन्दूधर्मसे पतभिन्नता धारण करनेवाला उपभेद नहीं है। जैनधर्मका उद्भव एवं इतिहास उन स्मृतिशास्त्रों तथा उनकी टोकाओंसे बहुत प्राचीन है जो हिन्दू कानून और रिवाजके लिए प्रामाणिक मानी जाती हैं। यथार्थ बात तो यह है कि जैनधर्म हिन्दूधर्म के आधारस्तंभ वेदोंको प्रमाण नहीं मामता । यह उन अनेक क्रियाकाण्डोंको अनावश्यक मानता है, जिन्हें हिन्दू लोग आवश्यक समन्नते है।"
इस प्रसंगमें बंबई हाईकोर्ट के न्यायमूर्ति संगलेकरका यह निर्णय भी महत्वपूर्ण होता है कि-"ह गाई कि जैम लोग वेदोंको अपना धर्म ग्रंथ नहीं मानते 1 ब्राह्मणधर्म के समान वे मृतके क्रिया कर्म, श्राद्ध एवं स्वर्गीय व्यक्ति के लिए नवेद्य अर्पण करनेकी बातको स्वीकार नहीं करते हैं उनकी यह भी घारपणा है कि औरस अमवा दत्तकपुत्रस पिनाकी आरमाको कोई भी आत्मीय श्रेय नहीं प्राप्त होता । वे ब्राह्मण धर्मवाले हिन्दुओंसे मृत भ्यक्तिके शरीर-दाह अथवा गढ़ानेके सिवाय अन्य क्रियाकाण्ड न करने के कारण पृथक हैं । माधुनिक

Vedas and repudiate the Brahmauical doctrines relating to obsequial ceremonies, the performance of Shradhas and the offering of oblations for the salvation of the soul of the deceased. Amongst them there is no belief that a 5011 by birth or adoption consers spiritual benefit on the father. They also differ from the Brahminical Hindus in their conduct towards the dead, omitting all obsequies after the corpse is burnt or buried. Now it is true as later historical researches have shown that Jainisin prevailed in this country long before Brahiminism came into existence or converted into Hinduism. It is also true that owing to their long association with the Hindus, who formed the majority in the country, the Jajns have adopted many of the customs and evert cerertionies strictly observed by the Hindus and pertaining to Brahminical religion,"
