sewers, ditches, drains, lights, liberties, easements, advantages, profits, privileges and appurtenances whatsoever to the said trust estate or any part thereof belonging of in anywise appertaining or with the same or any part thereof now or at any time heretofore usually held, used, occupied or enjoyed or reputed to belong or be appurtenant thereto. And all the estate, right, title, interest, claim and demand whatsoever both ag law and in Equity af them the said Manekchand Hirachand and Navalchand Hirachand into or upon the said trust estate and every part thereof. To have and to hold the said trust estate hereby granted and assured or expressed so to be unto the said trustees to the use - upon the trusts and for the ends intents and purposes and with under and subject to the powers, provisoes, charges, declarations and agreements hereinafter limited, declared and contained of and concerning the same that is to say tbat the said trustees shall hold and stand possessed of the said trust estate upon trust Fir. stly to allow such portion of the said trust estate as is coloured yellow on the plan here to appexed to be used as a Dharamsala or resting-place for the use and benefit of Jains and other high caste Hindus visiting Bombay for the purpose of travel, business, trade, profession, service, pilgrimage and other like purposes with power to the said trustees to allot and seta part for the purposes aforesaid such further portion or portions out of the said trust estate as are hereinafter directed to be let to tenants as the trustees may from time to time deem fit and proper. Provided always and it is hereby further agreed and declared that preference shall always be given to the Hindus professing the Jain pursuasion.
