________________ In his counter comments dated 22/10/96 the complainant submitted that the reply of the respondent was based on religious ill feelings, caste, community, disharmony, enmity, hatred and ill will to the Jain community and the followers of the Jain religions. He further submitted that the respondent dealt with the subject matter. The complainant further denied the allegations levelled by the respondent. He further submitted that they had also sent a separate letter dated 27/7/96 to the respondent but till date no reply had so far been received from him. The complainant prayed that the complaint be allowed and necessary action be taken agaisnt the respondent for publishing defamatory news items against the Jain community. A copy of the counter comments of the complainant was forwarded to the respondent on 20/11/96 for information. In a further communication received in the Secratariat of the Council on 17/12/96 the complainant submitted that they were surprised to receive the edition of the respondent "Shri Niklank Express" dated 19.11.96 on 10/12/96 at Mumbai in which severe criticism was levelled on the rejoinder. The complainant laso submitted that in the said edition certain remarks were also made against the Chairman, Press Council of India, Hon'ble Justice P.B. Sanwat and the Press Council. On perusal of the publication it has been found that the weekly has requested the Press Council of India to bind the complainant to clarify the truthfulness of Jain Granths or close the complaint made before it forever. He requested the Council to take stern action against the respondent for commenting and giving his views on the subject matter. Inquiry Committee: The matter was called out for hearing before the Inquiry Committee at Mumbai on 21.4.97. Shri T.M. D'Silva, Advocate with Shri Ranjeet R. Jain, Trustee appeared for the complainant Shri Sau Tipubai Rathanchand Jain Religious and Charitable Trust, Mumbai. The respondent newspaper, Shri Niklank Express, Barmer was not represented. A telegram was received from the respondent editor requesting for adjournment and hearing of the case to Delhi as he apprehended danger to his life in Mumbai. The Committee did not grant the adjournment and proceeded to consider the case. The complainant was aggrieved over the publication of a number of news items in different issues of the respondent newspaper. According to the complainant, the news items were anti-Jain Community. He further submitted that the impugned publications did not serve any public interest but had created descontent, hatred and disharmony amongst the followers of the Jain religion and the Jain Community. He further submitted that the President of the Trust had earlier also filed a complaint with the Press Council against the respondent newspaper for articles carrying reproduction from a book banned by Rajasthan Government because of its comments against Jainism. This was closed by the Council on 28/3/94 as the respondent editor had expressed regrets and had stated that he was not 88
