________________ RELEVANT EXTRACTS FROM DECISION OF PRESS COUNCIL OF INDIA S.No. 30 Shri Sau Tipubai Rathanchand Jain (Mutha) Religious & Charitable Trust, Mumbai Versus F.No. 14/180/96-97 The Editor. SHRI NIKLANK EXPRESS, Hindi Weekly Distt. Barmer, Rajasthan. Complaint: This complaint dated May 27, 1996 was filled by Shri Sau Tipubai Ratanchand Jain (Mutha) Religious & Charitable Trust, Mubai highlighting the allegedly subversive activities of the Sadhu Shree Anoodasji Jagat Hit Karni Mandal, Vasai East, District Thane and inter-alia stated that the impugned news items published in 'SHRI NIKLANK Express', Pachpadra nagar based Hindi weekly were anti-Jain. The captions and the dates of the impugned news items levelling allegations againt the Jain Community published in the aforesaid weekly from 1993-1995. The complainant submitted that Sadhu Shri Anoopdasji Jagat Hit Karni Mandal was promoting on the grounds of religion, caste and disharmony, enmity, hatred and ill-will between its followers and those who belonged to Jain religion. He further submitted that the Mandal was periodically publishing a bulletine named "Shri Niklank Express' through activists. The complainant further submitted that the Mandal had been distributing pamphlets also containing scurillous writings agains the Jain community. He further submitted that they had reasons to believe that the Mandal was being financed by foreign agencies who were interested in disrupting orderly life in the country. 87. The complainant further submitted that the respondent while publishing the impugned publication did not maintain the standard of public taste as the publications had created discontentment, hatred, disharmony amongst the followers of the Jain religion and the Jain community in general. The complainant also drew the attention of the Council to its own decision dated 28/3/94 in the complaint of President, Shree Jain Shwetabar, Khatargachcha Shre Sangh, Badmer against Shri Niklank Express and the matter was closed as the respondent editor had expressed regrets and also stated that he was not aware that the books from which he had taken the extracts were banned by the Government of Rajasthan. He further submitted that despite the earlier action taken against the respondent, the respondent had no affect and he continued to publish the news items against the Jain community. The complainant further requested that if there was only delay in filing the complaint, the same might be condoned.
