PAGE 24 The learned Trial Judge has also considered the facts and the law placed before him and according to me, he has rightly granted the Notice of Motion in terms of prayer clames a (i), a (ii) and a (iii). I do not find any illegality or perversity in the impugned Judgment and order of the learned Judge. There is
absolutely no infirmity or illegality in the ભાવાર્થ - મારા મતે, બે તિથિ પક્ષના વકીલ શ્રી અ નેએ રજુ
impugned Judgment. I also agree with the learned Judge that the balance of convenience would be in favour of the plantifits.
કરેલ સુપ્રીમ કોર્ટનો ઉપર દર્શાવેલ ચૂકાદ, પ્લેન્ટીફ (બે તિથિ નવાંગી ગુરૂપૂજા પક્ષ) ના પક્ષને; જૈન ધર્મનો એક ભાગ હોવાને લીધે અને એમના ધર્મની એમની શ્રદ્ધા મુજબની આચરણાની રીત હોવાને લીધે નવાંગી ગુરૂપૂજા અને બે નિધિ કરવાની બાબતમાં સંપૂર્ણપણે ટેકો આપે છે,

પ્રાર્થના ક્રમાંક a (i), a (ii) અને a (iii) ની બાબતમાં નોટીસ ઓફ મોશનની સુયોગ્ય રજા આપી છે. એ વિવાદગ્રસ્ત ચૂકાદામાં અને વિજ્ઞાન ભાવાર્થ – મારા મતે, પ્લેન્ટીકોએ (બે તિથિ પક્ષ - કાંતિલાલ જના આદેશમાં હું કશું જ ગેરકાયદેસર૫૬ કે ખોટાપણું જોતો નથી. એ ચૂકાદામાં કોઈપણ રીતે ચાશ કે ગેરકાયદેસરતા નથી. ન્યાયની અનુળતા પ્લેન્ટીના બે નિધિ માન્યતા પક્ષમાં છે. એ બાબતમાં હું વિદ્વાન જજ સાથે સંમત થાઉં છું.
ચુનીલાલ શાહ વગેરેએ) પોતાના વી સ્થિતિમાં રહેલા નવાંગી ગુરૂપૂજનને આચરતા જૈનોના હિતોનું સંરક્ષણ કર્યું છે.
ભાવા - હું વિદ્વાન એકલ જજ શ્રીમતી કે. કે. બામે લીધેલા દ્રષ્ટિકોણ સાથે આદ૨પૂર્વક સંમત છું તેથી બીજો જુદો અભિપ્રાય ધરાવી ન શકું. પ્રાથમિક મુદ્દાઓ ઉપર ટ્રાયલ જજ આર. બી. મલિકે પસાર કરેલા આદેશમાં કે કશી કચાશ કે ગેરકાયદેના જોતો નથી.

PAGE 52 - The civil court was well within its jurisdiction to grant appropriate interim orders and I do not see any wrong committed by the Trial Court. If the final result of the suit would be to permanently injecting the defendants from enforcing and implementing the impugned resolutions I fail to understand why the Trial Court cannot temporarily grant such an in uction. યોગ્ય વચગાળાના આદેશો આપવાની બાબતમાં સીવીલ કોર્ટ, બરબર પોતાની અધિકાર ક્ષેત્રમાં રહી છે અને ટ્રાયલ કોર્ટે કશું ખોટું કર્યાનું હું જોતો નથી. જ્યારે આ સ્યુટનો છેલ્લો ચૂકાદો ફેન્ડન્ટને (માટુંગા ટ્રસ્ટ - ટ્રસ્ટીઓને) આવા વિવાદાસ્પદ ઠરાવો ને ઠોકી બેસાડતાં કે અમલ કરતાં હમેશા માટે,
