પણ એવી જ માગણી કરી કે--આ તીર્થ સર્વથા દિગંબરનું જ છે એવી કોઈ જાહેરાત કરે. ઈસ્વીસન ૧૯૦૫ માં ટાઇમટેબલ કરીને દિગંબરને પૂજા વગેરેમાં સમાન અધિકાર એક વખત આપીને હવે તીર્થને સર્વાધિકાર (Absolute Right.) માગવાને વેતાંબરેને અધિકાર નથી. આ જાતને તેમણે એસ્ટેપેલ( અટકાવવા)ને કાયદો પણ ઉપસ્થિત કર્યો.
કેટે બન્ને પક્ષના પુરાવા તથા નિવેદનોને તપાસ્યાં અને પક્ષની અનેક વ્યક્તિઓની જુબાની લીધી. કમીશન નિમાયાં. અંતરિક્ષમાં જાતે જઈને તપાસ પણ કરવામાં આવી. છેવટે સન ૧૯૧૮ ના માર્ચની ૨૭ મી તારીખે આકેલા કેટના વધારાના ન્યાયાધીશે (Additional District judge) ૪૦ પાનાને લંબાણું ચુકાદો આપ્યો. તેમાં તેમણે જણાવ્યું કે તીર્થ અને મૂર્તિ તાંબરી જ છે, પરંતુ સન ૧૯૦૫માં વેતાંબરેએ ટાઈમ ટેબલ કરતી વખતે રાજીખુશીથી દિગંબરોને પણ અધિકાર આપ્યો હોવાથી હવે વેતાંબરોથી દિગંબરેના અધિકારને પણ ઈન્કાર કરી શકાય નહીં. લેપના સંબંધમાં ન્યાયાધીશે જણાવ્યું કે-પહેલાં પણ જ્યારે જ્યારે લેપ કરવામાં આવ્યો હતો ત્યારે ત્યારે કટિસૂત્ર અને કોટનો દેખાવ તેમાં કરવામાં આવતો જ હતો, એમ અનેક પુરાવાઓથી સિદ્ધ થાય છે. સંવત ૧૯૬૪(ઈસ્વીસન ૧૯૦૮)ના લેપ વખતે કવેતાંબરોએ તેમાં કંઈ પણ ઉમેર્યું હોય એમ હું ક્ષણવાર પણ માની શકતો નથી. આ જજમેન્ટને અનુસરતું હુકમનામું પણ સન ૧૯૧૮ના એપ્રીલની બીજી તારીખે આપવામાં આવ્યું તેમાં મુખ્ય હકીકત નીચે મુજબ છે
“બંને પક્ષના લોકેએ સં. ૧૯૬૧(સન ૧૯૦૫)માં થયેલા ટાઈમ ટેબલને વળગી
૧ ઈન્ડીઅન એવિડન્સ એકટમાં ૧૧૫ મા એકટમાં એસ્ટેપેલની વ્યાખ્યા નીચે મુજબ આપવામાં આવેલી છે -
" When one person has by his declaration, act or omission inten. tionally caused or permitted on other person to believe a thing to be true and to act upon such belief, neither he nor his representative shall be allowed in any suit or proceeding between himself and such person or his representative to deny the truth of that thing."
[ Indian Evidence Act, Chapter. VIII, 115 ] I am therefore unable to believe for a moment that any new marks were introduced by the artist in pasting the idol third time in 1908. [R. P. P. C; Part I, 282].
