"Their Lordship of the Council, therefore, having taken into consideration the appeal and humble petition, and having heard the counsels on both sides-report that the appeal (of the Digambaries) be dismissed, and the decree of the Court of Judicial commissioner of the Central provinces of the Ist October 1923 affirmed.""
Order of His Majesty in Council :
"HIS MAJESTY having taken the said report into consideration was pleased by and with the advice of his Privy Council to approve thereof and to order as it is hereby ordered that the same be punctually observed, obeyed and carried into execuiion.
Whether the judges of the Court of the Judicial Commissioner of the Central Provinces for the time being and all other persons whom it may concern are to take notice and govern themselves accordingly.
it is our deep regret that the dispute did not end here. Under their "right of worship' interference in management has continued all these years. Any structural changes in the temple, compound or any repairs in the property would be challenged physically resulting in Crim.nal and Civil Suits.
Following are some of the Judgments in Courts. For your information, substansiating what has been stated in para above.
(1) In, CR. A No. 211 of 1933 “ The Digambaris have only right of worship, and they have nothing to do with structural changes in temple."
(2) Cri Case No. 7 of 1936. "The Shwetambaris are entitled to build a Dharamshala. The Digambaris are not entitled to obstruct the work, by any means, peace. ful or otherwise. I hold that the Digambaris have been forcibly obstructing the work. If the Shwetambaris meet the obstructing as they are entitled to do so, a breach of peace is certain."
