This was Cri. C. No. 31 of 1909, dated 31-5-1909, on the file of S. D. M. Washim.
3. In 1910, Swetambari managers had undertaken repairs to the temple, and Digambaries obstructed them. There was quarrel. Case U/S 107 I. P. C. was put up against Shwetambaries, and they were all discharged by S. D. M. Washim on 13-9-1909. While passing order the Magistrate. held as follows.
Evidence in both cases shows that the Digambaries have all along been the aggressors. Shantinath and Chaturbhuj have not apparently been done any thing wrong, and have only doing necessary repairs and arrangement for temple." They are discharged.
4. In 1924, when the plaster was done by the Swetambaries, and when it had not dried up completely, on 3-2-1924, the Digambaries worshipped the same by poring milk, water, and other fluids, over the Idol, and thereby, caused damage to the Idol. Digambaries were proceed U/S 144 Cr. P. C. in the court of Dist. Magistrate, Akola. The Magistrate, however, found that there was no serious damage done to the Idol. Therefore, action was deferred.
5. In 1924, Digambaries had done acts falling U/S 295 I. P. C., by scratching the plaster of the Idol. at certain places. Swetambaries had filed a complaint against them, which was Case No. 12 of 24. The defendants, however, were acquitted.
6. In 1927, the Digambaries raised disputes regarding possession of field S. No, 197, and 198/1, and there was likelihood of breach of peace.
Proceedings under Section 145 was put up in the court of S. D. M. Washim in Misc. 15 to 27. This was decided on 17-12-27, and the court held that the Shwetambaries were entitled to the actual possession of the above field, property, and forbid all disturabances of their possession, until evicted therefrom, in due court of law.
