[Third Uddeshaka] [329 13. If a monk leaves the monastic community and engages in sexual intercourse, i.e., practices maithunaservana, then for the said reason, he is not eligible to be given or hold the position of acharya up to ganaavacchedaka for three years. After the passage of three years and upon entering the fourth year, if he becomes free from the arising of sexual desire, attains disgust towards sexual intercourse, and becomes devoid of sense-pleasures, then he becomes eligible to be given or hold the position of acharya up to ganaavacchedaka.
14. If a ganaavacchedaka engages in sexual intercourse without leaving his position, then for the said reason, he is not eligible to be given or hold the position of acharya up to ganaavacchedaka for life.
15. If a ganaavacchedaka leaves his position and engages in sexual intercourse, then for the said reason, he is not eligible to be given or hold the position of acharya up to ganaavacchedaka for three years. After the passage of three years and upon entering the fourth year, if he becomes tranquil, restrained, abstinent, and free from passion, then he becomes eligible to be given or hold the position of acharya up to ganaavacchedaka.
16. If an acharya or upadhyaya engages in sexual intercourse without leaving his position, then for the said reason, he is not eligible to be given or hold the position of acharya up to ganaavacchedaka for life.
17. If an acharya or upadhyaya leaves his position and engages in sexual intercourse, then for the said reason, he is not eligible to be given or hold the position of acharya up to ganaavacchedaka for three years. After the passage of three years and upon entering the fourth year, if he becomes tranquil, restrained, abstinent, and free from passion, then he becomes eligible to be given or hold the position of acharya up to ganaavacchedaka.
The scriptures have greatly extolled the virtue of brahmacharya (celibacy), and its observance has also been described as difficult. For the scriptural references, see Nishitha Uttara 6. Among the five great vows, brahmacharya mahavrata is the foremost.
Therefore, for its violation, the most severe penance has been prescribed here. In Nishitha Uttara 6-7, the transgressions and misconduct of this great vow have been prescribed the penance of guruChaumasi, and here, only the bestowal or non-bestowal of the positions of acharya, etc. have been mentioned as the penance.
That is, the maithunaservana (engaging in sexual intercourse) not only attracts the guruChaumasi penance as per the Nishitha Sutra, but the person also becomes ineligible for the positions of acharya, etc. for a minimum of three years or more, or even for life, as stated in these sutras. A monk who engages in sexual intercourse with a woman, even once or multiple times, while maintaining the appearance of asceticism, becomes ineligible to hold the positions of acharya, etc. for at least three years, despite possessing the qualities worthy of those positions.
