इसके शरीर को अत्यन्त पीड़ित करो (आस्फोटयति-अत्यन्तं कुट्टयतीत्यर्थः) इसको कूटो, मारो ।
__ अब सूत्रकार कहते हैं कि ऐसे पुरुष के पास जो कोई रहता है वह दुर्मन (दुःखित-चित्त) होकर ही रहता है और जब वह उनसे पृथक् हो जाता है तो प्रसन्नचित्त होकर रहता है । कुटुम्बी जन उससे पृथक् रहने पर इतना प्रसन्न होते हैं जितना मार्जार (बिल्ली ) के दूर होने पर मूषक ।
इस कथन से भली भांति सिद्ध किया गया है कि अपराधी को दण्ड देने का निषेध नहीं है किन्तु दण्ड विधान अपराध को देखकर न्याय से ही होना चाहिए, अर्थात् छोटे अपराध का छोटा और बड़े अपराध का बड़ा ही दण्ड होना न्याय है । नास्तिक यह नहीं देखता । वह छोटे बड़े सब अपराधों का एक समान कठोर ही दण्ड देता है । ... अब सूत्रकार उक्त विषय का ही वर्णन करते हैं:
तहप्पगारे पुरिस-जाए दंडमासी, दंड-गरुए, दंड-पुरेक्खडे अहिए अस्सि लोयंसि अहिए परंसि लोयंसि । ते दुक्खेंति सोयंति एवं झूरंति तिप्पंति पिट्टेइ परित-प्पन्ति । ते दुक्खणसोयण-झूरण-तिप्पण-पिट्टण-परित-प्पण-वह-बंध-परिकिलेसाओ अप्पडिविरया भवंति ।
तथाप्रकारः पुरुषे-जातो दण्डामृषी, दण्ड-गुरुकः, दण्ड-पुरस्कृतः, अहितोऽस्मिन् लोकेऽहितः परस्मिन् लोके । ते दुःखयन्ति, शोचयन्ति, एवं झुरयन्ति, तेपयन्ति, पीडयन्ति, परितापयन्ति, ते दुःखन-शोचन-झुरणतेपन-पीडन-परितापन- वध-बन्ध-परिक्लेशादप्रतिविरता भवन्ति ।
पदार्थान्वयः-तहप्पगारे-इस प्रकार का पुरिस-जाए-पुरुष-जात दंड-मासी-सदा दण्ड के लिए तत्पर दण्ड-गरुए-भारी दण्ड देने वाला दंड-पुरेक्खडे-प्रत्येक बात में दण्ड को आगे किये रहता है । अस्सि लोयंसि-इस लोक में अहिए-अहितकारी है और परंसि लोगंसि-पर-लोक में अहिए-अहित रूप है ते-वे पुरुष दुक्खेंति-अन्य लोगों को दुःखों
